THAT Council give first and second reading to City of West Kelowna Zoning Amendment Bylaw No. 0154.103, 2021 (File: Z 21-01); and 

THAT Council direct staff to schedule a Public Hearing for the proposed Zoning Amendment Bylaw.

Zoning Amendment Bylaw No. 0154.103, 2021 (1st and 2nd Reading); 2377 Thacker Drive 

This application is proposing to rezone a 22,008 m2 portion of the subject property, located at 2377 Thacker Drive, from Rural Residential Large Parcel (RU4) to Single Detached Residential (R1), to accommodate a 10-lot single family subdivision. An application to rezone the property was submitted previously under File Z 18-08 and eventually withdrawn. The proposal has now been revised and resubmitted under File Z 21-01 to limit rezoning to the upper bench portion of the property and exclude the existing single family dwelling from the proposed R1 area.

In summary:

The developers are planning in reducing the size of the development to the upper bench portion off Thacker Drive. This should eliminate any development which will directly affect the Casa Loma area.

2377 THACKER - PUBLIC HEARING RESULTS

At the April 7 Council Meeting, the Mayor and Councillors voted unanimously to allow for the 14 single house development accessed off Thacker Road (in Lakeview Heights) but not to allow for the single lot development accessed from Casa Loma. This amended development file will be represented to Council for 3rd Reading in the very near future.  We would like to once again thank City Council for making a good decision as it relates to Casa Loma, and hope our neighbors in Lakeview Heights also receive a good outcome with the part of the development that was approved.  Also a big thanks to all that showed up to the Public Hearing and/or wrote letters to help City Council and Staff come to their final decision.

January 29, 2020 Update:

The Public Hearing for 2377 Thacker Drive (adjacent to Casa Grande) was held on January 28th as per the notice below. It was well-attended by both Casa Loma and Lakeview Heights residents along with several CLCA board members. There was significant discussion about both the upper half (in Lakeview Heights) as well as the lower half of the property in Casa Loma. Risks for the steep lower half in the Casa Loma area were well documented by the City of West Kelowna staff and acknowledged in the Public Hearing. There was also discussion on the rezoning request to “R1 zoning” as the developer has indicated that only 1 (one) house would be proposed on that part of the site. The city discussed potential covenants being placed on the property to enforce this plan, should the file be approved for development. Given the numerous risks outlined by the City Staff in the report (link provided below), the CLCA Board of Directors will closely monitor this development proposal and keep the community well informed.

This file is now closed to public input while City Council deliberates on next steps.

Where and When: Tuesday, January 28, 2020, 6:00 PM Council Chambers 2760 Cameron Road, West Kelowna, BC

Summary: The applicant is seeking to rezone the entire parcel and amend the land use designation for a portion of the subject property to accommodate a 15 lot single family residential subdivision. The relatively large parcel features an existing single family home and an accessory home (permitted as an agricultural worker dwelling under Zoning Bylaw No. 871).
